Lobi Space Mailbox Service Agreement

This Mailbox Service Agreement ("Agreement") is between the customer identified in the approved membership application ("Customer," "you") and Nela Holdings & Investments, LLC, doing business as Lobi Space ad or it's affiliate companies not limited to Lobi Partners LLC ("Lobi Space," "we"), for mailbox and mail receiving services at 1655 S Blue Island Ave, Chicago, Illinois.

This Agreement supplements and does not replace the Lobi Space legal bundle you accepted at checkout: the Website Terms & Conditions, Membership Agreement, Privacy Policy, Cookie Policy, Acceptable Use Policy, Professional Standards Policy, Refund Policy, and your plan acceptance. It applies only to mailbox services, whether purchased as a Business Mailbox plan or included in a Virtual Office or Office Space membership. For mailbox services, if this Agreement conflicts with the Website Terms & Conditions, this Agreement controls; refunds are always governed by the 14-Day Refund Policy.

1. Lawful use
You will not use the mailbox, the Lobi Space premises, or any Lobi Space service for any unlawful, illegitimate, or fraudulent purpose, for any purpose prohibited by U.S. Postal Service regulations, or for mass-mail marketing campaigns. Your use must comply with all federal, state, and local laws.

2. USPS Form 1583
Each individual or entity receiving mail must be authorized on a completed USPS Form 1583, supported by two forms of valid identification, one with a photograph. Household members may share a form only as permitted by current USPS regulations. You agree to complete updated forms and acknowledgments (including any form relating to service of process) when we request them or postal rules require them.

3. Your service plan
Included mail volumes, scanning allowances, forwarding fees, storage fees, additional-recipient fees, and other usage charges are set out in the current Mailbox Service Schedule published on lobispace.com and in your member portal. The Schedule version in effect at the time of a request applies; changes are made as described in the Website Terms & Conditions. Lobi Space does not offer check-deposit service.

4. Digital mailbox software
Mail notifications, scans, and forwarding requests are delivered through a third-party digital mailbox platform (currently Anytime Mailbox). Your plan includes access to this software at no additional or separately stated charge, as described in the Included Software Access section of the Website Terms & Conditions; access ends when your mailbox service ends. Your use of the platform is also subject to any terms the platform presents.

5. Confidentiality
This Agreement and your Form 1583 are kept confidential, except that they may be disclosed on the written request of a law enforcement or other governmental agency or when legally required.

6. Access and authorized users
Possession of your digital mailbox sign-in credentials is valid evidence of authority to receive mailbox contents. Every person authorized to receive your mail must be listed on your Form 1583 (additional recipients per the Schedule), and you are responsible for the actions of anyone you authorize. In the event of your death or incapacity, we will require appropriate documentation — a power of attorney or documents from the probate court, executor, or trustee — before releasing mail to a requesting party.

7. Mail and package acceptance
As your authorized agent for receipt of mail, Lobi Space accepts mail and packages, including registered, insured, and certified items, and courier deliveries that require our signature. You must accept and sign for items when we request it. Packages not collected within three (3) days of notification accrue the per-day package storage fee in the Schedule, payable before release. If you refuse an item, we may return it to the sender, and you are responsible for return postage and fees. C.O.D. items are accepted only by prior arrangement with advance payment. We may open and inspect any item that arrives damaged or whose integrity or legality is reasonably in question.

8. Address format
You must use the exact mailing address assigned to your mailbox, in the format required by Form 1583, without modification. Courier deliveries must use the street address. Improperly addressed mail may be returned by the Postal Service as undeliverable.

9. Term and renewal
The term of this Agreement is the period you have paid for. Your plan renews automatically — as disclosed at checkout and in the master terms — until you cancel or Lobi Space declines renewal, which it may do with thirty (30) days' notice.

10. Termination for cause
Lobi Space may terminate this Agreement for good cause on thirty (30) days' written notice. Good cause includes: (1) abandonment of the mailbox; (2) use of the mailbox for unlawful, illegitimate, fraudulent, or mass-mail marketing purposes; (3) failure to pay amounts when due; (4) receipt of an unreasonable volume of mail or packages; (5) offensive, abusive, or disruptive behavior toward members or staff; and (6) violation of any provision of this Agreement. The actions of anyone you authorize are attributed to you. We may suspend service immediately where the law or USPS rules require it.

11. Notices
Notices to you are effective when sent by email to the address on your account; when placed in your mailbox (deemed delivered 24 hours after placement); when personally delivered; or, for abandonment terminations, one day after deposit with a next-day courier or five (5) days after deposit as USPS Certified Mail, Return Receipt Requested, addressed to you at your Form 1583 address — or on the date of actual receipt, whichever is earlier.

12. After cancellation or termination
a. New mail. After your service end date, we may refuse newly arriving mail and packages and return them to the sender as undeliverable.

b. 30-day window. Items already on hand remain available for pickup, or one final forwarding at the forwarding fee plus postage, for thirty (30) days after cancellation.

c. Extended forwarding. Before your end date, you may arrange forwarding for up to six (6) months, prepaid: postage, packaging, forwarding fees, and monthly storage per the Schedule.

d. Extended storage. Before your end date, you may arrange storage of mail and packages for up to six (6) months, prepaid per the Schedule.

e. No arrangement. After the 30-day window or the end of a prepaid period, remaining items may be returned to sender or, where return is not possible, securely destroyed. Unsolicited and bulk mail (addressed to "occupant," "current resident," or a similar designation, and coupons, advertising, or other promotional material) may be discarded at any time after service ends.

f. Records. We retain your Form 1583 and related records as USPS regulations require, even after your service ends.

13. Indemnification
You agree to protect, indemnify, defend, and hold harmless Lobi Space and its affiliates, parent companies, subsidiaries, franchisees, officers, directors, agents, and employees from and against all losses, damages, expenses, claims, demands, liabilities, judgments, settlement amounts, costs, and causes of action of every type arising out of or in connection with your use or possession of the mailbox or the services under this Agreement — including claims for personal injury or property damage, failure of the U.S. Postal Service or any courier service to deliver on time or at all, damage to or loss of any mail or package or mailbox contents from any cause, and any violation of law by you — including reasonable attorneys' fees and costs.

14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LOBI SPACE'S TOTAL LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED $100.00, REGARDLESS OF THE NATURE OF THE CLAIM.

15. Entire agreement; amendment
This Agreement, together with the documents it incorporates by reference, is the entire agreement between the parties regarding mailbox services and supersedes prior negotiations and understandings about mailbox services. It does not replace the master legal bundle you accepted at checkout. It may be amended only in a writing agreed to by both parties; email confirmation is acceptable.

16. Severability; waiver; assignment
If any provision is held unenforceable, it will be modified to reflect the parties' intent, and the remaining provisions stay in full force. A failure or delay in exercising any right is not a waiver, and a single or partial exercise does not preclude any further exercise. You may not assign this Agreement without Lobi Space's written consent; Lobi Space may assign it as part of a merger or a sale of all or substantially all of its assets.

17. Governing law; venue
This Agreement is governed by the laws of the State of Illinois, without regard to conflict-of-laws principles; the United Nations Convention on Contracts for the International Sale of Goods does not apply. Any action arising out of this Agreement will be brought exclusively in the federal or state courts having jurisdiction in Illinois, and each party consents to their exclusive personal jurisdiction and venue and waives any right to a jury trial.
